ERISA Litigation
Our ERISA Litigation team has substantial experience in a broad array of ERISA-related disputes where we have successfully prosecuted and defended ERISA litigation matters for our clients both at the federal trial court level as well as on appeal. We have handled ERISA cases and class actions in Alabama, Illinois, Iowa, Missouri, New York and Tennessee. We successfully obtained a complete dismissal of an ERISA fiduciary class action at the trial court level in Alabama which was recently upheld by the 11th Circuit Court of Appeals in Atlanta, Georgia.
We partner closely with our clients and proactively counsel them in strategic out of court resolutions; work with in-house legal counsel and HR management to draft and implement contracting practices and internal policies and procedures for avoiding potential ERISA claims; and conduct internal audits of business practices to advise senior management and in-house legal counsel on best practices. Our ERISA attorneys also regularly present seminars to legal, HR and benefits personnel of our clients to educate them on how to modify or eliminate practices which may create legal exposure under ERISA.
